ORERA Completion Guidelines Strengthened for Housing & Apartment Projects

The Odisha Real Estate Regulatory Authority (ORERA) has reiterated the mandatory documentation required for the completion of housing and apartment projects, ensuring strict compliance with the Real Estate (Regulation and Development) Act, 2016 and the Odisha RERA Rules, 2017.

According to the latest guidelines, promoters must furnish a series of statutory approvals and certificates before applying for project completion. These include a Stability Certificate, NOCs from Fire, Water, and Power authorities, lift operation approvals, and consent from the Odisha State Pollution Control Board (OSPCB). Additionally, Occupancy Certificates from the planning authority remain a key prerequisite.

Promoters are also required to submit:

  • Certificates from Chartered Accountants and Architects confirming completion,

  • An affidavit cum declaration affirming that the project matches advertised specifications,

  • Photographs as proof of full project completion, and

  • Handover details of common areas and undivided share of land to the Association of Allottees.

Further, the guidelines stress that 70% of funds collected from allottees must remain in a dedicated project bank account and be utilized strictly for construction. Any false declaration or non-compliance can attract penalties up to 5% of the estimated project cost under Section 60 of the RERA Act.

To ensure transparency, promoters must continue to submit Quarterly Progress Reports (QPRs) until the receipt of the Occupancy Certificate. They are also required to disclose details of borrowings, encumbrances on land, brokerage payments, maintenance charges collected, and insurance policies related to the project.

The move aims to strengthen buyer confidence and ensure timely delivery of quality housing projects across Odisha. Experts believe that stricter enforcement of these provisions will significantly enhance accountability and curb malpractice in the real estate sector.
